Terms of Service
These terms are an agreement between you and framevibe ("framevibe", "we", "us"), based in Tel Aviv, Israel. They govern your use of framevibe.ai — a web service for creating images and videos with AI (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Your account
- You must be at least 18 years old to use the Service.
- You must provide accurate information when signing up, keep your credentials confidential, and tell us promptly at support@framevibe.ai if you suspect unauthorised use of your account. You are responsible for activity under your account.
- The Service organises work in workspaces ("studios"). A studio administrator may invite other members; members see and may work with content in that studio, according to their role.
2. Credits and payment
- The Service is pay-per-use: you buy credits and spend them on generations. There is no subscription.
- The credit price of each generation depends on the model and the parameters you choose (for example video length), and is always shown before you run it. By running a generation you authorise that charge to your credit balance.
- If a generation fails on our side, the credits charged for it are automatically refunded to your balance. This covers technical failure — not dissatisfaction with a successful Output (see section 4).
- Credits may expire. Where credits have a validity period, it is disclosed when you receive them, and we send you a reminder before expiry (you can opt out of reminders — expiry applies regardless). Expired credits are removed from your balance.
- Credits have no cash value, are not transferable outside your studio, and — except where the law requires otherwise or these terms say so — purchases are non-refundable.
- Payments are processed by third-party payment providers, and prices may include applicable taxes such as VAT.
3. Your content and generated content
- Your inputs stay yours. You retain all rights you hold in prompts, reference images and videos, and other material you submit ("Inputs"). You grant us the licence needed to operate the Service: to host, process, and transmit Inputs — including to the third-party AI model providers that fulfil your requests — and to display results back to you and your studio.
- Outputs are yours to use. As between you and framevibe, we assign to you our rights, if any, in the images and videos generated for you ("Outputs"), and you may use them for any lawful purpose, including commercially. We make no promise that Outputs are protectable by copyright, or that similar or identical outputs will not be generated for other users from similar prompts.
- You are responsible for your content. You must hold the rights needed for anything you upload, and you are responsible for how you use Outputs, including checking them for accuracy and for third-party rights (for example trademarks, or the likeness of real people) before relying on or publishing them.
- We do not use your Inputs or Outputs to train AI models.
4. AI outputs — expectations and limits
Generative AI is probabilistic by nature. Please set your expectations accordingly:
- The same prompt can produce different results each time, and Outputs may be unexpected, contain artifacts or errors, or not follow every detail of your prompt.
- Outputs are limited by the capabilities of the underlying third-party AI models — including their prompt understanding, supported resolutions and durations, stylistic range, and known failure modes. We select and configure models carefully, but we do not control how a model interprets any given prompt.
- A generation is successful when the model you ran returns an output. The credit charge for a successful generation stands: we are not obliged to refund credits because an Output does not meet your expectations, preferences, or quality standards. Iterating on prompts is part of how creating with generative AI works.
- We may choose to issue a goodwill credit refund in individual cases; doing so is at our discretion and does not create an obligation to do so in other cases.
- This section does not limit the automatic refund for technical failures (section 2) or any rights consumer law grants you that cannot be waived.
5. Acceptable use
You must not use the Service to create, upload, or share:
- content that is illegal, or that facilitates illegal activity;
- sexual content involving minors, or any content that exploits or endangers children — this results in immediate termination and may be reported to authorities;
- non-consensual intimate imagery, or sexualised depictions of real, identifiable people;
- content that impersonates a real person or organisation in a misleading way, including deceptive "deepfakes" presented as genuine;
- content that infringes others' intellectual property or privacy rights;
- harassment, incitement, or content promoting violence.
You also must not:
- probe, overload, disrupt, or circumvent the Service's security or safety measures, including its content moderation;
- access the Service by automated means other than its intended interfaces, or resell it without our written agreement;
- misrepresent AI-generated content as human-made where that matters to the audience or is required by law.
Prompts and reference media may be checked automatically before generation, and we may refuse or cancel generations that appear to violate this section. Repeated or serious violations can lead to suspension or termination (section 9).
6. Third-party AI models
Generations are fulfilled by third-party AI model providers (currently Google, OpenAI, Black Forest Labs, xAI, ByteDance, and Recraft; the lineup may change). Model availability, behaviour, and output quality depend on these providers, and requests must also comply with the applicable provider's usage policies. We may add, change, or remove models at any time; pricing shown before each generation always reflects the current model.
7. Intellectual-property complaints
If you believe content on the Service infringes your rights, email support@framevibe.ai with enough detail for us to identify the content and assess the claim (what the content is, where it appears, what right is infringed, and how to reach you). We review complaints and remove or disable content where appropriate.
8. Availability and changes to the Service
We work to keep the Service available and fast, but it is provided without uptime guarantees: maintenance, upgrades, and factors outside our control (including third-party model providers) can cause interruptions. We may change or discontinue features; if we discontinue the Service entirely, we will give reasonable advance notice.
9. Suspension and termination
- You may stop using the Service and ask us to delete your account at any time.
- We may suspend or terminate accounts that materially or repeatedly violate these terms, create risk for the Service or others, or where the law requires it. Unless the violation prevents it, we will tell you the reason.
- On termination your right to use the Service ends. Sections that by their nature survive (including sections 3, 4, 10, 11, and 12) continue to apply.
10. Disclaimers
The Service and all Outputs are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated content can be inaccurate, incomplete, or unsuitable for your purpose — review Outputs before relying on them.
11. Limitation of liability
To the maximum extent permitted by law, framevibe will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to the Service; and our total aggregate liability for all claims will not exceed the greater of the amounts you paid us in the 12 months before the event giving rise to the claim or US $100. Nothing in these terms limits liability that cannot be limited by law.
12. Indemnity
You will indemnify framevibe against third-party claims and reasonable related costs arising from your content, your use of Outputs, or your breach of these terms, except to the extent the claim results from our own breach or wrongdoing.
13. Governing law and disputes
These terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules, and the competent courts of Tel Aviv–Jaffa have exclusive jurisdiction — provided that if you are a consumer in a jurisdiction whose law grants you mandatory protections or venue, those rights are not affected.
14. Changes to these terms
We may update these terms as the Service evolves. The "Last updated" date above reflects the current version; for material changes we will give you reasonable advance notice — for example by email or an in-app notice — and your continued use after the change takes effect constitutes acceptance. If you do not agree to a change, stop using the Service before it takes effect and contact us about your account.
